Each year H-2B Visa holders come to the United States from around the world to live and work, filling jobs where there is a shortage of American workers. Smart Staff can help arrange H-2B Visas for new workers or extend an H-2B Visa for a worker who already holds one.
The H-2B program is addressed to adults between 18-40 years of age from a variety of backgrounds currently interested in working in the US. All applicants are screened for appropriate English fluency, ability to function in a work environment and motivation. H-2B visa holders may work for a period of 4 to 11 months and can arrive at different times of the year. As a rule, H-2B visa holders can only work during the employer's specified season.
The process arranging H-2B visas for US employers and international seasonal staff takes approximately 4-5 months from the initial application to the arrival of the employee in the US.
• Complete the obligation free "Employer Registration Form" in full. An account manager will contact you to discuss your company's hiring needs and will send you an Employer Information pack.
• Submit the Employer / Smart Staff contract. Smart Staff will forward employee applications for your review. If needed, we can organize a recruitment trip to anywhere in Central and Eastern Europe where you will be able to interview candidates.
• Smart Staff files for the Department of Labor certification on behalf of the employer. Job advertisements are placed in local newspapers to ensure there are no suitable American workers available.
• Once Department of Labor certification is received, a final decision must be made on which employee(s) to hire. An "Employment Agreement" will be sent to each employee for his/her signature.
• Smart Staff submits the H-2B Visa Petition to the USCIS. Once a decision has been made on the H-2B Visa Petition, Smart Staff will inform both the employer and the employee.
• Employees apply for the H-2B Visa at the local US Consulate in their home country. After employees receive their visa, Smart Staff will arrange their transportation to the US and start work with you.
• Recruitment, screening and placement of employees.
• Employment Agreements.
• Processing the Department of Labor certification application and arranging adds in local newspapers to fulfill H-2B Visa requirements.
• Processing the H-2B Visa Petition with the USCIS and all paperwork for the H-2B Visa application and embassy interviews.
• Ensuring employees are covered by accident and sickness insurance and making low- cost coverage available when needed.
• Providing an "Employee Handbook" and "Inside the USA" guide for each employee.
• Ongoing 24-hour support for employers and employees.
